This week saw the start of compulsory registration for caterers. NTAK urges them to take the mandatory steps as soon as possible.

Extract of the new legislation:

Registration of catering businesses in the NTAK started on 1 November 2021. By law, all catering businesses are obliged to register, but only those catering businesses that are obliged to use a cash register to submit receipts are obliged to submit NTAK data.

Our previous article was written after a roundtable discussion on Data Services, where catering operators from Győr-Moson Sopron County gathered to discuss the details of the new legislation. Many questions and requests for the amendment were raised and we are still waiting for approval or a response.Read more on the official NTAK website.)

The discussion was moderated by Zoltán Szalai, Vice President of the Food Trade Department of the GYMSM KIK, who was asked what has happened since then and what we should expect in this period.

Zoltán Szalai: „Registration for the NTAK system starts on 1 November and will continue until 1 July next year. It's worth doing it as soon as possible to avoid problems later on. The next step is to launch the software, which will tell you what data you are expected to send, and then start using it to ensure that everything is up and running by the deadline. We are currently waiting. I'm confident that catering establishments will benefit from this legislation, whether in terms of human resources or other material things.”

How will the checks be carried out and by whom?

NTKA: The registration of the catering business with the NTAK and the regular and appropriate reporting of data to the NTAK, acting in its capacity as a trade authority, at the address of the catering business local notary checks.

Pursuant to Government Decree 210/2009 (IX. 29.) on the conditions for carrying out commercial activities, the registered catering business is subject to an official inspection at least once a year. The notary shall notify the operator of the NTAK of those catering establishments that are required to use catering software but do not have it, or it is established during the official inspection that they are not registered in the NTAK or have not or have not properly fulfilled their data reporting obligations as provided for in Government Decree No. 235/2019 (X. 15.) of 15 December 2009 implementing the Act on State Tasks for the Development of Tourist Areas.
